Welcome to Cup it!

The purchase and/or use of the Cup it! Game, and all items associated therewith (the “Game”), is at the purchaser’s and/or user’s (together, as applicable “you”) own risk and responsibility. By purchasing or participating in the Game, you understand that the Game involves physical activity that involves potential risk of personal injury, property damage, and/or financial loss. Furthermore, you voluntarily participate in the Game with an express understanding of such potential risks involved, and you accept and assume any and all risks of injury, damage, and/or loss arising from any participation in the Game. The Game is for participants ages 21 and up only. You agree that any alcoholic beverages you consume in connection with the Game, if and as permitted by law, are your own choice and responsibility; you agree to drink responsibility and heed all warnings and suggestions related to the consumption of alcohol; and you agree that you alone are responsible for all of your actions resulting from consuming alcohol. In no event will Cup it!, LLC, a Colorado limited liability company, nor its affiliates (together, “Company”) be responsible for any actions or inactions related to your participation in the Game or otherwise. 

YOU ASSUME ALL RISK AND LIABILITY FOR ANY USE OF THE GAME. IN NO EVENT WILL COMPANY BE LIABLE FOR ANY LOSSES OR DAMAGES RESULTING FROM ANY USE OF THE GAME, INCLUDING ANY CONSEQUENTIAL, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES. THE GAME IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, AND COMPANY MAKES NO WARRANTY WHATSOEVER WITH RESPECT TO THE GAME, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE, WHETHER EXPRESS OR IMPLIED BY LAW, COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE OF TRADE OR OTHERWISE.
